Terms and Conditions of Sale

BioNovu Red Light Therapy Bed

 

1. Introduction

These Terms and Conditions of Sale ("Terms") govern the purchase of the BioNovu Red Light Therapy Bed ("Product") by the Buyer from BioNovu ("Seller"). By placing an order, the Buyer agrees to these Terms.

 

2. Order and Payment

2.1 Orders are subject to acceptance by BioNovu. A binding contract is formed only upon written confirmation by BioNovu.

2.2 Payment must be made in full before shipment unless otherwise agreed upon in writing.

2.3 Prices are exclusive of taxes, duties, and costs unless otherwise stated.

2.4 A non-refundable deposit of one-third of the total cost is required at the time of order placement.

 

3. Shipping and Delivery

3.1 BioNovu will arrange for shipment to the Buyer’s specified location. Shipping dates are estimates only.

3.2 Risk of loss or damage transfers to the Buyer upon delivery.

3.3 The Buyer is responsible for inspecting the Product upon receipt and reporting any damages or discrepancies within 48 hours.

3.4 The Buyer must have at least two people available to assist with lifting the Product upon delivery. If assistance is required, BioNovu can arrange additional help at an extra cost.

3.5 Shipping is included in the purchase price.

3.6 The Buyer is responsible for arranging for an electrician to be on-site at the time of delivery to wire in the Product and ensure it is working properly. If needed, BioNovu can supply an electrician at an extra cost. If no electrician is available at the time of delivery and issues arise when the Product is later wired, an additional charge will apply for BioNovu to reattend and resolve the issue.

 

4. Pre-Order and Installation Requirements

4.1 To ensure a smooth delivery and installation process, the Buyer must confirm that the room dimensions, corridors, stairways, doorways, and entrance halls can accommodate the Product. If this has not been pre-approved by BioNovu before ordering, and the Product cannot be moved into the designated space, it will be placed at the front entrance upon delivery. The Buyer will be responsible for the Product from that point onward or it may be taken to a place where it can be stored until the issue is resolved. There may be an extra charge for this service.

4.2 The NovuBed is suitable for street-level delivery only.

4.3 The Product requires a minimum of 1 meter of clearance around it once installed to ensure proper operation and accessibility.

4.4 The Buyer must ensure that the floor can support the weight of the bed and any persons using it. BioNovu recommends a minimum floor load capacity of 600kg.

 

5. Warranty and Returns

5.1 BioNovu warrants that the Product is free from material defects for a period of 2 years from the date of delivery.

5.2 Warranty does not cover damage due to misuse, modifications, improper installation, or normal wear and tear.

 

6. Limitation of Liability

6.1 BioNovu is not liable for indirect, incidental, or consequential damages arising from the use of the Product.

6.2 BioNovu’s liability is limited to the purchase price of the Product.

 

7. Compliance and Safety

7.1 The Buyer is responsible for ensuring the Product’s use complies with local regulations and industry standards.

7.2 The Product is intended for professional and personal wellness use only and is not a medical device unless explicitly stated.

 

8. Governing Law and Dispute Resolution

8.1 These Terms are governed by the laws of [Jurisdiction].

8.2 Disputes shall be resolved through mediation or arbitration before any legal action is taken.

 

9. General Provisions

9.1 These Terms constitute the entire agreement between the parties.

9.2 No modifications or waivers are valid unless in writing and signed by both parties.

9.3 The Product must only be cleaned with hypochlorous solution. Use of any other cleaning agents will void the warranty.
